Growing Weed at Home Is Legal
Home cultivation became legal for all New York adults 21 and older in mid-2024 when the Cannabis Control Board adopted final regulations. Medical patients had been allowed to grow weed at home since October 2022, and the CCB extended the right to all adults once the regulatory framework was finalized.

Key Rules to Follow
- Security: Plants must be secured from anyone under 21. Use a locked room, greenhouse, or enclosed area that minors cannot easily access.
- Visibility: Plants cannot be visible from public areas without the use of binoculars or other optical aids.
- Indoor or outdoor: Both are permitted as long as security and visibility requirements are met.
- No sales: Selling homegrown cannabis is illegal, even to other adults. It is strictly for personal use.
- Home storage: You may store up to 5 pounds of cannabis at home from your harvest.
- Renters: Landlords may prohibit cultivation in lease agreements. Check your lease before starting.
Getting Started
If you're new to growing cannabis, the process requires some planning. You'll need to choose between seeds and clones, decide on an indoor or outdoor setup, and understand the vegetative and flowering stages. Plants typically take 3 to 5 months from seed to harvest.
New York's climate supports outdoor growing in many regions, particularly during the long summer days. The Hudson Valley, with its agricultural heritage, has become a hub for craft cannabis cultivation. However, the shorter growing season in northern New York and higher elevations may favor indoor cultivation.
