NY Cannabis Consumption Lounges

The MRTA promised consumption lounges, but none have been formally licensed. Here's the gray-area scene that's filling the void and what legislation may change.

The Unfulfilled Promise

The MRTA authorized on-site consumption licenses, envisioning dedicated spaces where adults could consume cannabis socially — the cannabis equivalent of a bar or lounge. As of early 2026, however, no consumption lounges have been formally licensed and opened through OCM's process.

The Office of Cannabis Management has prioritized retail dispensary licensing and taken what it calls a "methodical approach" to consumption spaces. With the retail rollout still playing catch-up after years of delays, consumption licensing has been pushed to the back of the regulatory queue.

Legislative Efforts

Assemblymember John Zaccaro has filed legislation to allow future consumption lounges to sell food, non-alcoholic beverages, and host live entertainment. If passed, this would create a more commercially viable model than the stripped-down framework currently contemplated by the MRTA.

The Gray-Area Scene

In the absence of formal licensing, a thriving gray-area lounge scene has emerged in New York City:

  • Astor Club — A Lower East Side cannabis speakeasy operating with an invite-only membership model. Styled after classic NYC private clubs.
  • Fly Private Social (Brooklyn) — Hosts hip-hop culture events with cannabis consumption, blending music and cannabis culture.
  • Cafe Cannal — Claims to be NYC's first cannabis cafe, offering a cafe-style experience with cannabis consumption.
  • Work'n'Roll (Flatiron District) — A cannabis co-working space, bringing the concept of consumption-friendly work environments to Manhattan.

These venues operate in legal gray areas. Several went underground during the 2024 enforcement wave as authorities cracked down on unlicensed operations. The distinction between an unlicensed lounge and an unlicensed dispensary is legally murky, making these operations inherently risky for operators.

What This Means for Visitors

Until formal consumption lounges are licensed, visitors have several legal consumption options:

  • Outdoors where tobacco is allowed — sidewalks, stoops, and pedestrian plazas
  • Private residences and vacation rentals — check host policies first
  • Cannabis-friendly accommodations — some boutique hotels permit cannabis use
  • Edibles in private spaces — no smoke, no smell, discreet consumption
