Visitor Purchase Rules
New York has no residency requirement for cannabis purchases. Tourists and visitors can buy from any licensed dispensary using a valid government-issued ID proving they are 21 or older. Accepted forms of identification include:
- State-issued driver's licenses from any US state
- US passports and passport cards
- International passports
- Military identification cards
- Tribal identification cards
Purchase limits are the same for visitors and residents: up to 3 ounces of flower and 24 grams of concentrates.
What Visitors Need to Know
New York still has thousands of unlicensed cannabis shops, particularly in NYC. Look for the OCM license displayed in the store. Licensed dispensaries test all products for safety and potency.
Cannabis cannot cross state borders — even between two legal states like NY and NJ. This is a federal offense. TSA operates under federal law at all airports.
You can consume on sidewalks, stoops, and patios. You cannot consume in vehicles, subways, hotels (unless permitted), or federal property.
Airport and Travel Rules
Cannabis cannot be transported through airports. TSA operates under federal law, and while TSA agents are not specifically looking for cannabis, if they discover it during a security check, they are required to refer the matter to law enforcement. JFK, LaGuardia, and Newark airports are all subject to these federal rules.
You also cannot transport cannabis across state lines, even between New York and New Jersey, where both states have legal markets. Interstate cannabis transport remains a federal offense regardless of state laws.
Hotels and Accommodations
Cannabis policies vary by hotel. Most major hotel chains prohibit smoking of any kind in rooms. However, many boutique hotels and vacation rentals in New York are cannabis-friendly. Always check with your accommodation before consuming on the premises.
If your hotel does not allow cannabis consumption, you can consume on the sidewalk outside (where tobacco smoking is permitted) or use non-smoking methods like edibles in the privacy of your room, though policies vary.
International Visitors
Visitors from other countries can purchase cannabis with a valid passport as ID. However, be aware that cannabis use may have immigration consequences. Non-citizens who admit to cannabis use at a border crossing may be denied entry to the United States. This is particularly relevant for Canadian visitors, who may be asked about cannabis use at the US-Canada border.
